This Privacy Policy explains how IntelUpsell LLC ("IntelUpsell," "we," "us," or "our") collects, uses, discloses, and protects personal information in connection with the IntelUpsell websites, applications, software, and related services (collectively, the "Services").

1. Scope

This Privacy Policy applies to personal information that IntelUpsell handles through the Services, including information relating to business customers, account administrators, authorized users, website visitors, customer support contacts, prospective customers, and other individuals who interact directly with IntelUpsell.

The Services are primarily offered to restaurants and other business customers to analyze sales interactions, evaluate upsell activity, create operational and employee performance metrics, support coaching, and provide related reporting. This Policy does not replace a customer's own employee, applicant, customer, or workplace privacy notices.

2. Our Role and Customer-Controlled Data

Information IntelUpsell controls

IntelUpsell generally determines how and why it processes information collected directly through its website, sales process, account administration, billing, security, and support activities. For that information, IntelUpsell acts as a business or controller under applicable privacy law.

Information processed for customers

When a business customer submits, connects, records, or otherwise makes information available through the Services, the customer generally determines the purpose and means of that processing. This may include audio recordings, transcripts, employee identifiers, sales interactions, operational records, performance results, and coaching information (collectively, "Customer Content"). For Customer Content, IntelUpsell generally acts as a service provider or processor on the customer's behalf and processes the information according to the customer's instructions, the applicable agreement, and law.

The information we collect depends on how you and the applicable customer use the Services.

We may collect billing contact information, subscription details, invoices, and transaction records. Payment card or bank account information may be collected directly by a third-party payment processor rather than stored by IntelUpsell.

Communications and messaging information

We collect information contained in support requests, surveys, feedback, emails, telephone calls, and service-related text messages. If a customer enables SMS or similar messaging, we may process recipient telephone numbers, message content, delivery status, and opt-out information on the customer's behalf.

Information from third parties

We may receive information from the customer's administrators, integration partners, identity providers, resellers, payment providers, analytics providers, and other service providers.

The Services may use automated speech recognition, machine learning, and artificial intelligence to transcribe audio, identify words or sales events, classify interactions, calculate metrics, detect patterns, and generate summaries or coaching suggestions.

IntelUpsell does not sell personal information for money or share personal information for cross-context behavioral advertising. We also do not knowingly sell or share personal information of individuals under 16.

7. Cookies and Similar Technologies

IntelUpsell and its providers may use cookies, local storage, pixels, software development kits, and similar technologies to keep users signed in, remember preferences, maintain security, understand website and product usage, and improve the Services. Browser controls may allow you to block or delete cookies, but doing so may affect functionality.

Where required by law, IntelUpsell will provide a cookie preference tool or obtain consent before using non-essential cookies.

8. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, fulfill the purposes described in this Policy, comply with the applicable customer agreement, maintain security and business records, resolve disputes, and meet legal obligations.

Customer Content is generally retained for the period selected by the customer or stated in the applicable agreement. Raw data, including raw recordings, is purged after six months, while analytics summaries and clips may be retained at the customer's preference. After account termination, IntelUpsell may provide a limited export period and then delete or deidentify Customer Content according to its standard deletion process, subject to backup cycles, legal holds, and information that must be retained by law.

9. Data Security

IntelUpsell uses reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure. Security measures are selected based on the nature of the information and the Services. No system, network, or method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Customers are responsible for maintaining appropriate account permissions, protecting credentials, configuring the Services, and promptly notifying IntelUpsell of suspected unauthorized access.

10. Your Choices and Privacy Rights

Account information

Authorized users may be able to review or update certain account information through the Services. Customer administrators control many user records, permissions, and Customer Content fields.

Marketing communications

You may opt out of marketing emails by using the unsubscribe link in the message or contacting us. Even after opting out, we may send non-marketing communications about an account, security, support request, or transaction.

SMS communications

Where a customer enables SMS or similar messaging, recipients may opt out of text messages at any time by following the instructions in the message, such as replying STOP, and may reply HELP for assistance. Message frequency varies. Message and data rates may apply. Customer-directed operational messages may be governed by the customer's policies and applicable law.

We do not sell, rent, or share mobile phone numbers or text-messaging opt-in consent with third parties or affiliates for their own marketing or promotional purposes. Mobile information is used only to deliver and support the messages that you or the applicable customer have requested.

This section supplements the rest of this Policy for residents of states with comprehensive privacy laws, including California where applicable. The categories below describe information IntelUpsell may have collected during the preceding 12 months, depending on the Services used by a customer.

IntelUpsell uses these categories for the purposes described in Sections 4 and 5. IntelUpsell does not sell these categories for money or share them for cross-context behavioral advertising. IntelUpsell does not use or disclose sensitive personal information for purposes that require a right to limit under California law, unless it first provides the required notice and choice.

IntelUpsell may recognize legally required universal opt-out preference signals, such as Global Privacy Control, when the signal applies to a processing activity covered by law. Because IntelUpsell does not currently sell or share personal information for targeted advertising, such a signal may not change our current practices.

12. Children and Minors

The IntelUpsell public website and direct account registration are not directed to children under 13, and IntelUpsell does not knowingly collect personal information directly from children under 13 through those channels.

Because restaurant employees may include minors, the Services may process limited work-related information about individuals under 18 when a business customer lawfully provides or directs that processing. The customer is responsible for complying with child labor, workplace notice, consent, and privacy requirements applicable to minors. 13. Data Processing in the United States

IntelUpsell is based in the United States, and personal information may be processed and stored in the United States and other locations where IntelUpsell or its service providers operate. Those locations may have different data protection laws than your jurisdiction. Where required, IntelUpsell will use an appropriate legal mechanism for cross-border transfers.

14. Changes to this Policy

We may update this Privacy Policy from time to time. We will post the updated version and revise the "Last Updated" date. If changes materially affect how we use personal information, we will provide additional notice or obtain consent where required by law or contract.
